When Algorithms Misdiagnose: The Legal Future of AI in Healthcare

As artificial intelligence reshapes the practice of medicine, it also redefines who is accountable when machines make mistakes.

In a hospital in Texas, a 56-year-old woman receives a rapid lung cancer diagnosis—not from a seasoned physician, but from an algorithm. Within seconds of processing her chest scan, the AI model flags a suspicious mass and recommends urgent follow-up. The diagnosis, confirmed by a human radiologist, saves her life. Yet two months later, another patient in a neighboring state undergoes unnecessary treatment after a similar AI tool mistakenly classifies a benign nodule as malignant. The consequences are not only medical—they’re legal. Who, if anyone, should be held responsible?

Artificial intelligence is no longer on the horizon of healthcare; it’s here. It’s reading X-rays, flagging tumors, predicting patient deterioration, and automating administrative burdens that once consumed hours of clinicians’ time. These breakthroughs offer the promise of faster, more accurate, and more equitable care. But they also pose a novel question: When a machine makes a mistake, who stands trial?

Artificial intelligence is transforming diagnostics, patient care, and administrative work, making healthcare more efficient and personalized. Yet the implications go beyond workflow or innovation. They strike at the foundation of medical jurisprudence: liability, accountability, and the physician-patient relationship.

The Legal Vacuum of Algorithmic Care

Traditionally, malpractice law hinges on human error. Physicians, nurses, and hospital administrators can be held accountable under tort law when their actions—or inactions—result in harm. The standard is relatively clear: did the provider deviate from the accepted “standard of care,” and did that deviation directly cause injury?

But what happens when an AI tool—approved by the FDA, integrated by a hospital system, and endorsed by peer-reviewed studies—produces an error? Does the responsibility fall on the clinician who used it? On the institution that deployed it? Or on the developer that created it?

This uncertainty represents what legal scholars call a “black hole of liability.” As The Journal of Law and the Biosciences explains, existing malpractice frameworks are ill-equipped to handle non-human decision-making agents. The assumption baked into malpractice law is that a licensed provider is exercising judgment, not simply accepting machine recommendations.

The Physician’s Dilemma

Consider a physician using an AI-assisted diagnostic tool to interpret an MRI. If the algorithm recommends a diagnosis that the physician follows, and that diagnosis turns out to be wrong, is the physician negligent for trusting the software? Conversely, if the physician disregards the AI’s recommendation—perhaps based on intuition—and the patient is harmed, might they be liable for overriding the “more accurate” machine?

This is the bind now facing providers. In a legal landscape where the “standard of care” is rapidly shifting to include AI tools, clinicians are expected to integrate these technologies while still bearing the brunt of liability.

A 2022 survey in the New England Journal of Medicine found that 68% of physicians using clinical AI tools were uncertain about their legal responsibilities when those tools made errors. The lack of clear legal guidelines is not only causing hesitancy in adoption—it’s sowing confusion in accountability.

Regulatory Lag

The U.S. Food and Drug Administration (FDA) has created a regulatory pathway for Software as a Medical Device (SaMD), which allows AI products to receive market clearance. Yet this framework primarily assesses premarket safety and effectiveness, not downstream liability. Once deployed, AI tools operate in dynamic environments—across diverse populations and unpredictable clinical contexts.

Europe appears to be leading in this area. The proposed Artificial Intelligence Act by the European Union classifies healthcare AI as “high risk,” demanding greater transparency, risk mitigation, and potentially, shared liability between developers and users. Legal scholars suggest it may serve as a prototype for global standards, particularly in delineating fault in cases of harm.

In the U.S., however, responsibility still largely falls back on clinicians. A few states have proposed AI-specific tort legislation, but none have yet codified how liability should be distributed when autonomous systems contribute to a clinical decision.

The Developer’s Role—and Escape

Software developers, particularly those working in large tech firms or health startups, often argue that their products are “clinical decision support” tools—not replacements for physicians. This distinction matters. If AI is considered a “tool,” like a stethoscope or thermometer, it avoids product liability. But if it functions as an autonomous decision-maker, the legal landscape changes.

Yet the doctrine of “learned intermediary”—which assumes the physician has final authority—protects most software developers from being sued directly. In effect, doctors remain the legal shock absorbers of algorithmic care.

This has led to calls from ethicists and attorneys for a redefinition of “shared liability,” where developers, hospitals, and clinicians collectively bear responsibility depending on the nature of the error and level of automation. But this requires new legal standards, and perhaps even new courts trained in digital health jurisprudence.

Informed Consent in the AI Age

Beyond malpractice, there’s another dimension of liability emerging: informed consent. If a patient receives care significantly influenced—or even determined—by AI, should they be explicitly informed? And do they have a right to opt out?

The American Medical Association recommends transparency, arguing that patients must understand the role AI plays in their diagnosis and treatment. Yet these are guidelines, not laws.

Without statutory requirements for disclosure, patients may not know that their care is algorithmically mediated, complicating post-harm litigation. A plaintiff could argue that they would have made a different medical decision had they known the recommendation came from a machine.

Real-World Cases—and a Warning

While the case law is still sparse, signs of what’s to come are already visible. In 2023, a telehealth company in California was sued after an AI-powered triage tool failed to recommend urgent care for a patient who later died of sepsis. The lawsuit named the provider, the platform, and the software vendor. It was eventually dismissed on procedural grounds, but legal analysts viewed it as a precursor to future litigation battles.

The stakes will only grow as AI becomes embedded in care pathways—from diagnostics and drug dosing to mental health screening and post-discharge monitoring.

The Road Ahead: A Legal Renaissance?

To navigate this terrain, stakeholders must come together: lawmakers, regulators, technologists, providers, and ethicists. Together, they must ask the uncomfortable questions: Should AI be granted legal personhood in certain contexts? Should malpractice insurance be restructured to include algorithmic risk? Do we need a new class of “digital medical courts”?

Medical law has always evolved with science—from antiseptic surgery to gene therapy. But artificial intelligence poses a challenge of a different order. It doesn’t just change what medicine is. It changes who—or what—is practicing it.

Until then, we remain in a legal limbo where patients trust a system that can’t yet answer a basic question: when an algorithm fails, who is to blame?
